Persons who stop working on a farm must inform the Social Security Centre (Centre commun de la sécurité sociale - CCSS).
The same applies to persons who have applied for an early old-age pension or disability pension and are reducing their farming activity.
Persons concerned
Farm managers, assistants or partners who cease or reduce their activity within a farm or with an association of farms.
How to proceed
Pension
Farmers who wish to apply for an early old-age pension or disability pension must contact the National Pension Insurance Fund (Caisse national d'assurance pension - CNAP) to find out which formalities need to be completed. After confirmation to the right of pension by the CNAP, the farmer must inform the CCSS if one of the two situations arises:
- they continue to work despite receiving a pension, if they are the only person affiliated on the farm;
In this case, they must send a statement of livestock held and the areas farmed on the day of the application for early old-age or disability pension ('Erhebung der Tiere und bewirtschafteten Flächen am Tag der Beantragung einer vorzeitigen oder Invaliden-Rente'). Only the areas used and the animals kept at the time of the application for a pension must be indicated. From the date of the pension, the total standard gross margin must be less than EUR 9.600.
The farmer is then exempt from affiliation as a farmer.
Please note that the farmer may continue to work beyond the age of 65, even if they are receiving a pension.
or
- they cease their activity.
In this instance, they must follow the instructions of the CCSS concerning the cessation of activity.
Handover of the farm ('Betriebsübergabe')
Information about the handover of the farm can be found by following this link.
Closing of the farm
The farm manager who wants to close their farm must contact the Rural Economy Department (Service d'économie rurale - SER) or the Wine Institute (Institut viti-vinicole - IVV) directly. The SER or IVV in turn inform the CCSS when a farm has ceased its activities.
The CCSS disaffiliates the insured persons on the farm in question (in this case the farm manager, assistant or partner) on the date mentioned in the communication from the SER or IVV correspondence. The CCSS also informs the persons in question by letter.
If there are employees on the farm, the farm manager must disaffiliate the employees in question by submitting a termination form to the CCSS.
How to proceed when an assistant or partner ceases their activity
Assistants or partners who stop working on a farm must submit an exit declaration form for self-employed persons to the CCSS.
