Incapacity for work covered by the employer

- employee sick leave where the employer has not fulfilled their obligations to continue paying the wage up to the end of the month in which the 77th day of continuation of the wage payment is reached for a period of 18 months or where this limit is no longer reached (article L.121-6, paragraph 3, subparagraph 2 of the Luxembourg Labour Code);

- the cash benefit set out in article 54 of the Social Security Code is to be paid to the employee during this same period of incapacity for work due to leave for family reasons, family hospice leave or sickness during the first 3 months of a probationary period.

Please note: during the COVID-19 crisis (from 01.04.2020 and up to the end of the month in which the crisis will be declared to have ended), leave due to sickness or an accident are not covered by the employer, but by the National Health Fund (CNS).
