Self-employed persons or their assisting spouse or partner who temporarily or permanently cease their activity.
How to proceed
Self-employed persons who temporarily or permanently cease their activity must notify the Social Security Centre (Centre commun de la sécurité sociale - CCSS). This also applies to their assisting spouse or partner.
The termination form must include the following information:
- the self-employed person's details;
- the date on which activity ceased;
- the reason for the cessation of activity;
- the place, date and self-employed person's signature.
To adjust their estimated income for the actual affiliation period, it is in the interests of self-employed persons to send a provisional income adjustment application with the termination form when they cease their activity.
No termination form has to be submitted when the self-employed person ceases or suspends their activity due to illness or temporary incapacity to work. Entitlement to cash benefits paid by the National Health Fund (Caisse nationale de santé - CNS) is guaranteed on condition that the self-employed person is duly affiliated with the Luxembourg social security system.
Self-employed persons who wish to retire must contact the National Pension Insurance Fund (Caisse nationale d’assurance pension - CNAP) for information on how to proceed. After confirmation of entitlement to a pension from the CNAP, the self-employed person must inform the CCSS if one of these two situations arises:
- they continue their activity with an income below one third of the minimum wage (EUR 901,25). In this instance, they may submit a request for exemption from affiliation for all social security coverage to the CCSS.
- they cease their activity. In this instance, they must follow the CCSS instructions on ceasing activity.
Please note that self-employed persons may continue to carry out their activity beyond the age of 65, even if they receive a pension.
Temporary suspension of activity
Self-employed persons or assisting spouses or partners who wish to temporarily suspend their professional activity must notify the CCSS by filling in a termination form.
If the suspension of activity is linked to parental leave, the applicant contacts only the Fund for the Future of Children (CAE) which will inform the CCSS.
A termination form for an assisting spouse must be signed by both parties, the assisting spouse or partner and the main insured person.
When a self-employed person is disaffiliated, their assisting spouse or partner also loses their affiliation, even if they have not expressly requested this.
In case there may be employees to be disaffiliated, the self-employed person, as their employer, must submit a termination form for each employee to the CCSS.
Ceasing activity
Self-employed persons or assisting spouses or partners who cease their professional activity must notify the Social Security Centre (Centre commun de la sécurité sociale - CCSS) by filling in a termination form.
When a self-employed person is disaffiliated, their assisting spouse or partner also loses their affiliation, even if they have not expressly requested this. If only a termination form for the assisting spouse or partner is submitted, it needs to be signed by both parties, the assisting spouse or partner and the self-employed person.
Persons who pursue an ancillary self-employed activity abroad and who are affiliated with the Luxembourg social security system for this activity, must submit to the CCSS a proof of cessation of activity, issued by the competent authority abroad, in order to disaffiliate.
In case there may be employees to be disaffiliated, the self-employed person, as their employer, must submit a termination form for each employee to the CCSS.
