Voluntary agricultural accident insurance covers anyone who is the victim of an accident that occurs while tending a declared plot of land, whether the victim is the insured or another person assisting them with the work.
Persons concerned
A natural person who farms the required minimum amount of agricultural land but is not subject to mandatory affiliation as a farmer.
How to proceed
Conditions for admission
The following persons may register for voluntary agricultural accident insurance:
- anyone who does not meet the criteria for mandatory affiliation as a farmer;
- anyone who farms the required minimum amount of land, namely:
o 3 hectares of agricultural land;
o 0.10 hectares of vineyard;
o 0.50 hectares of forest or a tree nursery;
o 0.30 hectares of orchard;
o 0.25 hectares of market garden.
Registering voluntarily for agricultural accident insurance
The application for admission to the voluntary agricultural accident insurance scheme must be sent to the Social Security Centre (Centre commun de la sécurité sociale - CCSS) using the 'Application for voluntary agricultural and sylvicultural accident insurance' form.
Among other things, the form must include the cadastral number and the commune, separately for each plot farmed.
After receiving and accepting the application, the CCSS duly informs the applicant by post.
Insurance cover begins on the day after receipt of the application for admission to the voluntary agricultural accident insurance scheme.
Annual declaration of the number of hectares farmed
Each year, at the earliest at the end of September, the CCSS sends the insured an 'Information and census' form (in French 'Information et recensement' and in German 'Mitteilung und Erhebung') by registered post. The insured must return this form by 31 December of the same year completed with the number of hectares farmed or which they intend to farm.
If the insured does not return the census form to the CCSS by 31 December of the same year, the voluntary agricultural accident insurance will be terminated and not renewed for the following year.
Contributions and payment
The contributions are calculated each year based on the type of agricultural land declared and mentioned on the contributor account statement (invoice).
The contributions are calculated for a full year.
The annual account statement for agricultural accident insurance is issued in November of the year concerned. If the contributions are not paid by the end of the year, the insurance is terminated on 31 December and the insured is excluded for the following year.
Example
In November 2019, the CCSS sends the insured an invoice for the 2019 contributions. If this invoice is not paid, the insurance is terminated on 31 December 2019 and the insured is excluded for 2020. To be readmitted for 2020, the insured must first pay the outstanding debt for 2019.
